Dealing With Child Protective Services
Until it happens, few people realize that their children can be taken from their home with as little as a phone call based on unproven allegations. A child can be removed from a home based solely upon the opinion or initial observations of a law enforcement officer or social worker without a trial or hearing. Responding to false allegations quickly and effectively can often be the difference between a child staying at home or being placed in foster care. Understanding the process is critical to knowing what your rights are and how to proceed.
The Dependency and Neglect Process
Most cases involving child abuse begin with a phone call made to either the police or other government department. Under the law, child abuse is defined very broadly as any act or omission that threatens the health or welfare of the child.
After an initial investigation the case may be closed or if the investigator finds that there is any reason to believe the allegation is true, the child can be taken from the family and placed in protective custody.
Once a child is placed in protective custody there begins a potentially long process of petitions, advisements and court hearings the end result of which could be the temporary placement of the child in foster care or, in extreme cases, the permanent removal of the child from the home. Knowing your rights and how to prepare your case is critical to defending your rights and maintaining your family.
What Can You Do
Fortunately, there are certain legal safeguards which are in place to protect the rights of a child's parents or custodians. These safeguards however, must be implemented quickly. Time is of the essence in all child abuse cases. Depending on the case, a hearing can be scheduled in as soon as 48 hours to determine who your child will live with until the case is resolved. Under Colorado law, you are entitled to legal representation at any hearing or court appearance. You are also entitled to present evidence on your own behalf. Preparation is always key to success in court.
At the Law Office of Keith Sandoval, I will help evaluate your case so that you can work with child protective services to obtain the best possible outcome for you and your children. If necessary, I will work with you to effectively prepare so that all the facts and circumstances surrounding your case are presented properly in court.
