Domestic Violence Cases

Domestic violence cases are those in which an act or threatened act of violence has been committed upon a person with whom the actor is or had been involved in an intimate relationship. Domestic violence also includes other crimes against a person or property when used as a means of coercion, control, punishment, intimidation or revenge. Intimate relationships are those between spouses and former spouses. Even past or present unmarried couples and couples who have are the parents of the same child are considered to have had an intimate relationship.

The consequences of being convicted of a domestic violence related case can be very serious and can impact the relationship you have with your children for years to come. Those convicted of domestic violence can find themselves precluded from making any decisions with regard to their own children and can even find their visitation time extremely limited. Additionally, persons accused of domestic violence offences are almost always subject to retraining orders, the violation of which can result in additional criminal charges.

Restraining Orders

Restraining or "Protective" orders frequently arise in domestic as well as civil and criminal cases. These orders are intended to protect the individual, and sometimes their minor children, from acts or threats of physical violence. These orders can also provide protection from situations such as harassment and stalking. At the Law Office of Keith Sandoval, I'll pursue the issuance of these orders for the protection of my clients on both a temporary and permanent basis.

I also defend clients against whom a restraining or protective order has been improperly or inappropriately issued. Often, such orders are issued without grounds to support the allegations. Frequently in domestic disputes, restraining and protective orders are used to gain unfair advantage against a party, particularly when the issue is child custody and parenting time. In these cases I work diligently to defend and protect the rights of our clients.
