My Spousal Support Practice
In Colorado, as in other states, spousal support or alimony is not automatically granted in divorce proceedings. Instead, the court will make a determination of whether alimony is appropriate, based on the consideration of a number of factors, including:
- the length of the marriage
- the age and health of the parties
- the earning capacity of each party
- the lifestyle to which the parties have become accustomed
- the value and distribution of all marital assets, including retirement accounts
- whether or not child support has been granted
